1. About Nesthant

Nesthant is a digital marketplace that allows:

• Developers and agents to list properties for sale or rent.
• Users to search, view, and interact with verified listings.
• Buyers and renters to contact listing owners directly.

Nesthant provides the platform but does not act as a real estate broker, agent, or intermediary between users.

2. Eligibility

To use Nesthant:

• You must be at least 18 years old.
• You must provide accurate and complete information during registration.
• You agree not to use the platform for fraudulent or illegal activities.

If you create an account on behalf of a business or agency, you represent that you have authority to bind that entity to these Terms.

3. User Accounts

Users, agents, and developers can register for accounts.

You are responsible for maintaining the confidentiality of your login details and for all activity under your account.

Nesthant reserves the right to suspend or terminate any account that violates these Terms or is used to post misleading or false information.

4. Property Listings

When listing a property, you agree that:

• You are the lawful owner or authorized representative of the property.
• All details, prices, and media (photos, videos, floor plans) are accurate and truthful.
• You will not post misleading, duplicate, or offensive content.
• You must pin the exact location of the property on the Kenya map.
• Properties under construction must be marked as "Ongoing."

Nesthant may remove any listing that violates these requirements or applicable laws.

5. Content Ownership

All property listings, photos, videos, and text remain the property of their respective owners.

By posting on Nesthant, you grant us a non-exclusive, worldwide, royalty-free license to display, promote, and distribute your listing content solely to operate the platform.

You retain all ownership of your uploaded material.

6. User Interaction and Reviews

Users may rate and review agents or developers based on their experience.

You agree:

• To post only genuine and respectful reviews.
• Not to use reviews to harass, defame, or mislead others.

Nesthant reserves the right to moderate or remove any inappropriate reviews or comments.

7. Developer & Agent Verification

Nesthant verifies profiles based on submitted details and documentation where applicable. However, final responsibility for due diligence lies with the user.

Nesthant does not guarantee the authenticity of all listings or participants.

8. Prohibited Activities

You agree not to:

• Upload malicious code or attempt to disrupt the platform.
• Use Nesthant for unlawful purposes.
• Impersonate another user or misrepresent your affiliation.
• Copy, scrape, or resell data from the platform without permission.

Violating these terms may lead to account suspension or legal action.

9. Payments and Featured Listings

Nesthant may offer premium or featured listing services.

All payments for such services are handled securely through integrated payment systems or authorized third parties.

Payments made for featured listings are non-refundable once activated.

10. Intellectual Property

All rights to the Nesthant name, logo, design, and software belong to Nesthant or its licensors.

You may not copy, distribute, or reverse-engineer any part of the platform without written consent.

11. Limitation of Liability

Nesthant is a digital platform, not a real estate agent.

We do not:

• Guarantee sales, rentals, or successful transactions.
• Verify legal ownership of listed properties.
• Accept responsibility for loss, damage, or fraud between users.

You use Nesthant at your own risk. The platform is provided "as is" without warranties of any kind.

12. Termination

We may suspend or terminate your access if:

• You violate these Terms;
• You post false or illegal listings;
• You misuse user data or platform services.

Upon termination, your right to access or post on Nesthant immediately ceases.
